UP Forest Employees Minimum Wage: Allahabad High Court of Uttar Pradesh has given big relief to the forest workers. The High Court has ordered the state government to pay a minimum wage of Rs 18,000 to all the daily and muster roll employees working in the Forest Department as per the recommendations of the Seventh Pay Commission. This order was given by Justice Ajit Kumar to Vijay Kumar Srivastava of Gorakhpur and others. Given while hearing the petition.

What is the whole matter

Actually, Allahabad High Court of UP has given a big decision in the Puttilal case. The High Court has termed the attitude of the Additional Chief Secretaries of the Finance and Forest Department as criminal contempt of court, contrary to the instructions given by the Supreme Court in the Puttilal case, and ordered both the departments to pay the salary of the Seventh Pay Commission to all the daily and muster roll employees working in the Forest Department. Under the recommendations, an order has been given to pay a minimum wage of Rs 18000.

The state government had given an affidavit

Petitioner’s advocate Pankaj Srivastava said that the committee constituted under the chairmanship of Principal Chief Secretary Forest, Environment and Ecology Change Department had recommended minimum wage and had also filed an affidavit in the court informing that under the Sixth Pay Commission, a salary of Rs 7000 would be given. There is a policy consensus to pay minimum wage of Rs 18,000 under the Seventh Pay Commission to all daily wage workers till they are regularized. Now the state government is retracting saying it is against the rules. Financial Hand Book Part 6 has not been declared unconstitutional. Therefore, daily wage workers do not have the right to get minimum wages.

18 thousand minimum salary will be given under the seventh pay commission

The High Court said that the government does not have the right to deny the benefits of the Seventh Pay Commission by giving the benefits of the Sixth Pay Commission. The government had said that those who are getting Rs 7000 will be given a salary of Rs 18 thousand per month and the court gave the decision. The Additional Chief Secretary, Finance and Forest Department has been directed to follow the order or explain why contempt charges should not be made. The next hearing of the case will be on December 4.
