GST Rate: Big update for tax payers, now they will have to pay 28 percent tax, check here

GST: The Finance Ministry has notified the date of October 1 for the implementation of the amended provisions of the GST law for e-gaming, casino and horse riding. According to the amendments in the Central GST Act, e-gaming, casino and horse riding will be treated as ‘actionable claims’ like lottery, betting and gambling and will attract 28 percent GST (Goods and Services Tax). In such a situation, these have come into effect from today 1st October. However, e-gaming companies said that since many states have not yet passed amendments to their respective State GST (SGST) laws, this notification of the Central Government will create confusion in the CGST and IGST laws.

As per the changes in the Central GST Act, online gaming, casinos and horse racing will be treated as ‘actionable claims’ on par with lotteries, betting and gambling and will be subject to 28 per cent GST on the full face value of the bets. According to the amendments in the integrated GST law, it will be mandatory for foreign online gaming platforms to register in India and pay tax as per domestic law.

The amendment to the Integrated GST (IGST) Act has made it mandatory for offshore online gaming platforms to register in India and pay 28 percent tax as per domestic law. The GST Council, comprising finance ministers of the Center and states, in its meetings in July and August had approved amendments to the law to include online gaming, casinos and horse racing as taxable actionable claims and clarified that such supplies But the full stake value will be taxed at 28 percent.

Amendments to GST laws

To give effect to the Council’s decision, Parliament last month passed amendments to the Central GST and Integrated GST laws. After this, the rules for valuation through these companies were also notified on September 6. In a letter to Revenue Secretary Sanjay Malhotra, the All India Gaming Federation (AIGF) has asked that as about 15 states have not yet made changes in their respective state GST laws, register online gaming companies through those states. What will be the GST action to be adopted in respect of deposits received from players?

The Federation requested the Center to reconsider these notifications and keep them suspended until all the States pass their respective amendments in line with the GST scheme and the judgment of the Supreme Court of India and in the meantime issue necessary clarifications.
