Arvind Kejriwal did not get bail from Delhi High Court, Delhi CM will remain in jail

Chief Minister Arvind Kejriwal did not get relief from the Delhi High Court on Tuesday. The court stayed the lower court’s decision to grant bail to the Delhi CM. The Delhi High Court has accepted the ED’s petition in which it was demanded to stay the lower court’s bail order to Arvind Kejriwal in the money laundering case related to the excise policy scam.

New Delhi. The Delhi High Court on Tuesday once again stayed the bail of Chief Minister Arvind Kejriwal in the money laundering case related to the excise policy scam. The court said that the material presented by the ED before the lower court was not considered and it is wrong.

The trial court did not apply its mind to the material – HC

During the hearing on bail today on Tuesday, the High Court said that the trial court’s comment that voluminous material cannot be considered is completely unfair. The court said that the attitude of the lower court shows that the trial court has not applied its mind to the material.

The lower court should have given the ED an opportunity to properly argue the bail plea. The court said that the mandatory conditions of PMLA were not fully debated in the lower court.

Earlier, on its petition, the Enforcement Directorate had filed a written reply in the Delhi High Court on Monday and informed that the lower court’s order granting bail was based on distorted conclusions.

ED had raised questions on the decision of the lower court

ED had argued that Rouse Avenue’s vacation judge Justice Bindu did not consider the material presented by the investigating agency regarding the crime. The agency argued that apart from this, the court did not give ED an opportunity to properly debate the matter.

At the same time, in the written reply filed by Chief Minister Arvind Kejriwal on the matter, it was said that the vacation judge before whom the case was listed on June 14 had a working day of one day. In such a situation, on the consent of both the parties, the case was listed before the vacation judge sitting on June 19, whose working day was two days.

ED had presented cross-examination for 1 hour 15 minutes

The note said that on June 19, Kejriwal was cross-examined for one hour and ED for two hours. After this, during the hearing on June 20, ED presented its cross-examination for one hour and 15 minutes. Cross-examination took place for five hours and 30 minutes in the entire case and the investigating agency also filed its written reply before the court.

After this, after considering all the material, the court gave the decision to grant regular bail. It said that Kejriwal had no direct contact with Vijay Nair and Vinod Chauhan. Not only this, ED does not have any proof of spending money in Goa elections.
