The High Court has clearly told the state government that the fifth revised pay scale will be paid to the petitioners within 4 weeks.

Jharkhand High Court has once again taken an important decision in the interest of the employees. The new class III and IV employees of the college board will be given the benefit of the fifth revised pay scale. For this, while hearing the petition of Mohammad Salim and others, the High Court has given orders to the Director of Higher Education. The action will be completed within four weeks.

Payment orders within four weeks

It was said in the argument of the Director of Higher Education that the names of the petitioners are not there in the Commission’s report, hence they cannot be given the benefit of the fifth revised pay scale. The court of High Court Justice SN Pathak rejected the argument of the Director of Higher Education. The High Court has clarified during the hearing that the University had recommended giving the fifth revised pay scale to the petitioners, hence the Director should have agreed to this. During the hearing, the High Court said that there is no order to the Director of Higher Education that when the University has sent a fixation in someone’s name regarding the fifth revised pay scale, then the payment should not be made, ignoring it.

Argument rejected

Here, while giving information in the court, the Director of Higher Education had said that the names of the petitioners were not there in the report of Justice SB Singh and Aggarwal constituted by the Supreme Court. Due to which he was not paid the fifth revised pay scale. The petitioners argued in the court that the university had recommended their names for the fifth revised pay scale and had sent a report to the state government for this.

On which the High Court clarified that the University had recommended granting fifth revision to the petitioners. In such a situation, the Director of Higher Education will have to pay it. Within 4 weeks all the petitioners will get the benefit of fifth revised pay scale. With this, a big increase in their salary will be recorded. Rs 22000 to 27000 can be seen in his account.
