Employees Retirement Age: High Court has also given relief to those employees who cannot be reinstated after completing the age of 60 years, ordering to give 2 years’ salary to such retired employees by deducting their pension as compensation.
Employees Retirement age 2024: There is relief news for the Class IV government employees of Himachal Pradesh. The Himachal High Court has given a big decision in the interest of Class IV government employees. Under this, now Class IV employees will be retired only after completing the age of 60 years. Not only this, the employees who have been retired before the age of 60 will also be called back.
Class IV employees will not retire before 60 years
Actually, the Himachal Pradesh government had made an arrangement in February 2018 that Class IV employees appointed after May 10, 2001 would be retired on completion of 58 years of age. This notification was challenged before the High Court through various petitions. While disposing of 112 petitions, the High Court, a division bench of Chief Justice MS Ramachandra Rao and Justice Jyotsna Rewal Dua ordered the state government to retire Class IV employees only on completion of 60 years of age. Employees who have been retired before the age of 60 years should be recalled.
Relief to those who retired before 60 years
The High Court ordered that employees who are in government service after 10 May 2001 should also be retired on completion of 60 years of age. Class IV employees who have been retired before the age of 60 years should be recalled for the job, such employees should also be retired at the age of 60 years. The court has also given relief to those employees who cannot be reinstated due to completion of 60 years of age. The court has ordered to give 2 years’ salary to such retired employees by deducting their pension as compensation.
Those above 60 years will also get benefits
The High Court said in its order that Class IV employees who are continuing their services even after 58 years in view of the interim order will work till the age of 60 years, those who have not received interim orders will work till the age of 60 years after their services are restored and Class IV employees who have already completed 60 years of age will be paid financial benefits for two years after 58 years. Let us tell you that there are about 19 thousand Class IV employees in the state.
