Gratuity Rules: Modi government has changed the rules for calculating gratuity of central employees. Now on the basis of these rules, gratuity will be available on the retirement of central employees. Under its purview, all those Central Government employees, Civil Government Servants working in Defense Services, who are in Government service since January 1, 2004.
According to the recently notified Central Civil Services (Payment of Gratuity under National Pension System) Rules, 2021, any claim made in respect of gratuity will now follow these rules. According to this rule, the day on which any government employee has retired or is retiring or is retiring, that will be his last working day. Apart from this, if a government servant dies, then that day should be considered as his last working day.
When is Gratuity available?
- When a government employee completes 5 years of qualifying service, he gets the benefit of retirement gratuity.
- Retirement is attained at the age of retirement.
- Have taken or taken retirement before the age of retirement.
- If he is shown Surplus in the department and he retires with Special Voluntary Retirement Scheme.
- If an employee is allowed to go to any company or corporation of the Central Government.
Gratuity Calculation
Retirement gratuity will be one-fourth of the employee’s salary in these cases. It will be made every 6 months with the completion of service. The maximum will be 16 and a half times. Harishankar Tiwari, General Secretary, All India Accounts and Audit Committee, said that salary here means basic pay, which a government employee starts getting immediately after his retirement. In case of doctors, non-practicing allowance is also added to the emoluments. This allowance is available in the name of private practice.
Meaning of qualifying service
Tiwari told that Qualifying service means when the employee starts work, his service starts from the same day. Even if he has started work on that post as officiating or on a temporary basis. Here it will be seen that there is no break till the appointment in officiating or temporary service.
