Haryana: High court petition for ban on Internet services, said – violation of fundamental rights

The petition said that according to the Supreme Court’s decision in the case of Anuradha Bhasin, freedom of speech and expression and freedom of profession in relation to the Internet also fall under Article 19 (1) (a) and 9 (1) (g) Huh.

A petition has been filed in the Haryana High Court for suspension of Internet services by the Central Government and the Haryana Government. The petition has demanded that Internet services be restored immediately. Petitioner Sandeep Singh and others, through advocates Rajwinder Singh Bains and Navkiran Singh, have opposed the shutdown of internet services and termed the notification issued by the Haryana government on 29 January 2021 as a violation of Articles 19 and 21.




The petition said that according to the Supreme Court’s decision in the case of Anuradha Bhasin, freedom of speech and expression and freedom of profession in relation to the Internet also fall under Article 19 (1) (a) and 9 (1) (g) Huh. It has been mentioned in the petition that banning of internet by the central and Haryana government is a violation of fundamental rights. The petitioner, who is a lawyer in Haryana, said that the sudden suspension of Internet services has affected his life and work.

Internet ban for peace and public order
Following the violence over agricultural laws, the Haryana government had extended the ban on internet services in seven districts till 2 February at 5 pm to maintain peace and public order. According to an official statement, the Haryana government has suspended Internet services in seven districts – Kaithal, Panipat, Jind, Rohtak, Charkhi Dadri, Sonipat and Jhajjar till 2 February 5 pm.

The ban on mobile internet has not been extended to Ambala, Bhiwani, Sirsa, Fatehabad, Kurukshetra, Karnal and Hisar. Where the internet was banned till 1 February evening. On Sunday, the government had suspended mobile internet services in Yamunanagar, Palwal and Rewari districts till 31 January.
