The bill regarding Uniform Civil Code in Uttarakhand has been presented in the Assembly. Chief Minister Pushkar Singh Dhami himself brought the bill in the House today. This bill includes important points related to marriage and divorce.

Chief Minister Pushkar Singh Dhami has presented a bill in the Uttarakhand Assembly regarding Uniform Civil Code. Now there will be a discussion on this in the Assembly, after which voting will take place on the bill. The draft of this bill has included issues including mandatory registration of marriage, divorce through judicial process.

1- At the time of marriage, the age of the man should be 21 years and the age of the woman should be 18 years. Registration of marriage will be mandatory under section 6. Failure to do so will also result in a fine of Rs 20,000.

2- No man or woman will be able to go to court for divorce until the period of marriage has completed one year.

3- No matter what religious practice the marriage is performed, divorce can happen only through judicial process.

4- Any person will get the right to remarry only when the court has given a decision on divorce and there is no right of appeal against that order.

5- For marrying against the law, six months’ jail and a fine of up to Rs 50 thousand can be imposed. Apart from this, there is a provision of imprisonment up to three years for taking divorce against the rules.

6- Second marriage between a man and a woman can be done only when neither of the partners is alive.

7- If either the man or the woman has had physical relations with someone else while being married, then it can be used as a ground for divorce.

8- If someone has married due to impotence or deliberately taking revenge, then anyone can go to court for divorce.

9- If a man has raped a woman, or if the woman has become pregnant from someone else while being married, then a petition for divorce can be filed in the court. If either man or woman converts, it can be made the basis for a divorce petition.

10- Men and women will have equal rights regarding property. There will be no discrimination of any kind in this. Apart from this, many types of rules are also included regarding will and inheritance.
