Under the new rules, border and immigration officers will now be able to cancel temporary resident documents such as study and work permits. These changes have been implemented by Immigration, Refugees and Citizenship Canada (IRCC), have come into effect from January 31, 2025 and have been published in Canada Gazette II. In this way, the difficulties of people thinking of studying or working in Canada have increased even more.
“IRCC will continue to invest in processes and improve tools to secure the border and protect Canada’s immigration system,” IRCC said in a statement. Under the new rules, officers can cancel electronic travel authorizations (eTA) and temporary residence visas (TRV). This can happen if a person becomes ineligible, provides false information, has a criminal record or their circumstances change.
Under what circumstances can work and study permits be cancelled?
Apart from this, study and work permits can now be cancelled in certain situations. For example, if the permit holder becomes a permanent resident, dies or if the document was issued due to an administrative mistake. Why were the rules changed?
The government has made these changes so that the credibility of Canada’s immigration system remains better. This also ensures that temporary residents follow the conditions of their visa properly. Actually, earlier the officers had the right to reject visa or permit applications, but they could cancel the permits that had already been issued with limited powers. But after the implementation of the new rules, they have got full power to cancel the permit.
After the new rules, if a permit holder does not fulfill the conditions, the government can take action against him. It is worth noting here that these changes have been made at a time when scrutiny of the temporary resident program in Canada has increased. The government is currently also working to reduce the misuse of study permits.
