Traffic Rules: Big Update! Changes in traffic rules regarding minor children, if caught while driving, heavy fine will be imposed, order issued

UP Traffic Rules: To prevent road accidents in Uttar Pradesh, it has been decided to completely ban driving by minor children. If a teenager under 18 years of age is found driving a motorcycle, scooter or car in the state, then the vehicle owner or the guardian of the children can be punished with imprisonment of up to three years and a fine of up to Rs 25,000.

Dr. Suchita Chaturvedi, member of Uttar Pradesh State Commission for Protection of Child Rights, said that many accidents are taking place on the roads due to driving by children below 18 years of age. Data given by KGMU and Lohia Institute also shows that 40 percent of those who lose their lives in road accidents are minor children, whose age is between 12 to 18 years. Therefore, the law will be enforced to strictly prevent children below 18 years of age from driving in the state.

What does the law say?

There is a provision in Section 4 of the Motor Vehicles Act, 1988 that no person below the age of 18 years can drive a motor vehicle in any public place. But after attaining the age of 16 years, any teenager can ride a motorcycle with engine capacity less than 50 CC in any public place. Along with this, there is a provision in Section 5 that the owner of any motor vehicle can neither drive nor allow any person to drive the vehicle who does not have a valid driving license.

Will be jailed for 3 years

Apart from this, through the Motor Vehicles Amendment Act, 2019, a new section 199A has been added in relation to motor vehicle offenses committed by juveniles, under which a provision has been made that in case of a motor vehicle offense committed by a juvenile, the guardian of the juvenile/owner of the motor vehicle should be punished. He will be considered guilty and punished.

In this, the guardian of the juvenile/adolescent girl/owner of the motor vehicle can be jailed for up to 3 years and fined up to ₹ 25 thousand and the registration of the vehicle used in the crime will be canceled for a period of 1 year and the driving license of such a juvenile will be suspended for 25 years. This can be done only after completing the age of 15 years.
