Vehicle Ownership Transfer: Nominee can be made only while purchasing vehicle, major changes in the rules of motor vehicle

Vehicle Ownership Transfer: A major change has been made in the Motor Vehicle Act today, which will directly benefit the vehicle owners. The Ministry of Road Transport and Highways has made a major change in the Central Motor Vehicles Rules (1989) today. Due to which the vehicle owner can make a person a nominee in the registration certificate only when purchasing a car or bike. This will go a long way in transferring the vehicle.




If the vehicle owner dies, it will be easy to transfer the vehicle in the registration certificate in the name of the nominee. In general, after the death of the vehicle owner in such a situation, the process of transferring the vehicle to someone else’s name was quite complicated. Not only this, the rules were also different in different states.




but according to this new rule of the Ministry, the nominee can be declared only when purchasing the vehicle, or later the nominee can be added as the second honor of the vehicle online. For this, the vehicle owner will have to apply online. To declare a nominee, the vehicle owner must also submit the identity card of the nominee.

Notice to be given within 3 months:

As per the information released by the Ministry of Road Transport and Highways, if the vehicle owner dies, his death will have to be reported to the authority within 30 days. Apart from this, the person named in the vehicle registration certificate will have to apply by filling Form 31 to transfer the vehicle to the registering authority within 3 months of the death of the said person. The vehicle owner can also change the nominee later, as is done in property-related matters.

Explain that the Ministry of Road Transport and Highways had on November 27, 2020 proposed to amend the Central Motor Vehicles Rules, 1989 for the convenience of the vehicle owner to enroll a person in the certificate of registration. It is being reported that the government had also invited suggestions and comments from the public and all stakeholders on the proposed amendment.
